When you have a small business or work for a firm that engages in advertising, you have got to make sure your advertising schemes are both effective and legal. Many forms of advertising create the kind of controversy that isn’t good for business and causes legal hassles. It’s not worth it. So take these three tips to ensure that your advertising endeavors stay on the right side of the law.
- Make sure your advertising is not in any way deceptive. False advertising is a crime and it is prosecutable, so be sure you only make accurate claims.
- Photographs, graphics, quotes, or written material in an advertisement must be obtained through appropriate permissions processes. Never use copyrighted material unless you have obtained the rights to do so.
- Stay away from using the word “free.” You can be sued for claiming that something is free when there are hidden costs.
